Business Transactions Between Tennessee Farmers Cooperative\Coop Financial Solutions and Yoder Farms Natural Beef, LLC
In January of 2021, James Yoder (Executor for the Dorothy Yoder Estate) contacted TFC and discussed the account for Yoder Farms Natural Beef, LLC (TFC number 1042290) with Rhonda Durham. James instructed her to close the account due to the passing of both company owners and the closure of the LLC. Per her verbal affirmation, the account was closed. James Yoder also completed an application for a new account with TFC, (See attached). Based on statements and invoices after the account setup, it appears TFC used the former LLC account number (TFC number 1042290) and changed that account information with the information James provided on his application. The company name on the account statement changed from Yoder Farms Natural Beef, LLC to Yoder Farms Natural Beef.
For the 2021 year, James Yoder sub-rented the Estate farm to his brothers, Dennis Yoder and Gene Yoder. They continued to place orders for farming goods and services with TFC. The long-standing custom of TFC billing practice was for monthly statements to be mailed out to the customer. None of the account activity was mailed or received in such manner.
In December of 2021, Rhonda Durham called James Yoder and informed him of 19k dollars worth of goods and services on the account (1042290). James’ response was that he was not aware of any outstanding balance. Rhonda explained that because the account was in Estate that settings in TFC accounting system excluded it from mailing statements. Therefore, none were sent or received. James’ response was that the first concern was that 1. (no more activity be allowed on the account), and 2. (That we need paper copies to review). Rhonda assured me that settings were changed, and no more activity could be added to the account.
The first statement received in the mail from TFC was received and dated 01-27-2022. On this statement, the name on the account has been changed from (Yoder farms Natural beef) back to the old name of (Yoder Farms Natural Beef, LLC). This demonstrates that TFC has internally been crossed up on the accounting between 2 separate businesses\owners. The first, which is the deceased Norman Yoder and Dorothy Yoder, Owners of Yoder Farms Natural Beef, LLC and the second, James Yoder, Owner of Yoder Farms Natural Beef.
On January 28th 2021, TFC filed a claim in the Court of Henry County Tennessee against the Estate of Dorothy Yoder (See attached). This is positive proof that 1. (TFC was aware of the Estate), 2. (The accounting system should not have been such that continuing business activity in the 2021 year would be systematically held up from being conveyed to the customer in the manner it normally and historically would have been conveyed.
Upon learning of this situation, sub-renters Dennis and Gene Yoder communicated with TFC staff about a possible resolution to this matter.
